What does the $699 fixed fee include?
The fixed fee includes a written review of your HIA or Master Builders home building contract pack before signing. We comment on key contract clauses, special conditions, specifications, drawings, allowances, exclusions, payment stages, time provisions and practical issues to raise with the builder.
Is this only a legal review?
No. The review is carried out by a construction lawyer with engineering and quantity surveying experience. We look at legal, technical and commercial risks, including scope, specifications, provisional sums, prime cost items, latent conditions, construction period and payment risk.
What documents should I upload?
Upload the contract, special conditions, specifications, plans or drawings, tender, quote or proposal, and any emails or documents the builder gave you before signing.
Do you review HIA and Master Builders contracts?
Yes. We review HIA home building contracts and Master Builders home building contracts.
Does the fixed fee include land purchase or conveyancing documents?
No. This fixed-fee review is limited to the home building contract and construction contract pack. It does not include review of a land purchase contract, land acquisition contract, conveyancing contract or property acquisition documents. If land acquisition documents also need to be reviewed, that is separate work and can be quoted separately.
Can you review a contract that has already been signed?
Yes, but the review is most useful before signing. If the contract has already been signed, we can still review the documents and identify risks, obligations and possible issues, but your ability to negotiate changes may be limited.
Do you negotiate with the builder for me?
No. The fixed-fee review gives you an owner review document and a builder discussion document identifying practical issues to raise with the builder. Negotiation, drafting amendments, correspondence with the builder or further legal work can be separately agreed if required.
What do I receive after the review?
You receive two outputs: an owner review document for your own use, explaining how the contract works, your duties and responsibilities and the highest-risk issues; and a builder discussion document you can take or issue to the builder, identifying clarifications, changes or amendments to raise before signing.
How long does the review take?
The aim is to provide the review promptly after payment and receipt of the contract pack. Timing depends on the size and condition of the documents.
Will you check whether the price is fair?
We do not provide a full quantity survey or market pricing report under the fixed fee. However, we do comment on obvious cost risks such as provisional sums, prime cost items, allowances, exclusions, unclear scope and items that may lead to later price increases.
Will you check the construction period?
Yes. We can comment on whether the construction period appears short, long or risky in the context of the documents, and on delay clauses, extension of time provisions and liquidated damages.
What happens after I upload and pay?
Your contract pack is reviewed and you receive an owner review document plus a builder discussion document identifying key risks, missing documents, issues to clarify and matters to raise with the builder before signing.
